§ 12-112. Unlawful drilling for oil, gas or water.

  • (a)

    It shall be unlawful for any person, corporation, or any other legal entity, other than the city or its agents, to drill for oil, gas or water resources from within the corporate limits of the city.

    (b)

    This article establishes penalties for any person, corporation, or any other legal entity that violates this article; each day will constitute a separate violation. The city may institute a civil action against any person, company, corporation or other entity in violation. In addition to injunction relief, a civil penalty not to exceed $5,000.00 for each willful occurrence, and actual damages suffered by any person or the city, including remedial relief and punitive damages may be awarded, together with actual costs and full attorney's fees. The remedies provided are in addition to any other action permitted by law, and are not intended to limit any action by any person or property owner suffering actual damages as a result of the violation.
